After considering evidence presented by the Monmouth County Prosecutor's Office, a grand jury in Freehold last week agreed that there is enough evidence to formally charge the following defendants and require them to respond to charges. But an indictment is not a finding of guilt or a conviction, and all defendants are considered innocent until proven guilty.

• Kayla Acceturo, 22, of Park Avenue in Union Beach was indicted on Jan. 22 on one charge she was in possession of heroin and suboxone on June 16, 2012 in Middletown Township.  She was arrested by Middletown Police on June 17. Third degree crimes carry the potential penalty of 3 to 5 years in prison. 

• Ulysses Torres, 43, of Union Avenue in Union Beach was indicted on Jan. 22 with one count of failure to register his home improvement business with the Division of Consumer Affairs when working in Middletown Township, as required by the Contractor's Registration Act. (NJSA 56:8-138). Failure to register is a fourth degree crime, and carries the potential of an 18-month prison sentence if convicted.

• Justin D. Duryea, 22, of Garfield Avenue in Keansburg was indicted on Jan. 22 on charges he had in his possession a stolen 2009 Yamaha Raptor ATV valued at $6,000, a third degree crime. He was also charged with having the black trailer used or ATVS, also a third degree crime. He was charged in Middletown. He was held on $15,000 bail, no ten percent option, set by Judge Richard Thompson.

• James McBurney, 23, of Navesink Avenue in Middletown was indicted on January 23 by a grand jury in Freehold on three counts. He was charged with burglary in Keyport, on August 18, 2012.  He is also charged with forging a check two days later to the Sovereign Bank, and committing theft by deception for obtaining $500 in cash belonging to another person. The burglary and forgery charges are considered third degree crimes. Theft by deception is a fourth degree crime, and carries the potential for an 18 months in jail.

• Joseph Davino, aka Joseph Barbella, 36, of Oakhurst was indicted by a grand jury on Jan 24 on one count of receiving stolen property, for allegedly bringing guitars and speakers he likely knew belonged to someone else into the state of New Jersey. Receiving stolen property is considered a third degree crime.
