Judge Rules Against Obama Objectors

An effort to have President Barack Obama's name removed from New Jersey's primary ballot was dealt a setback following an administrative judge's recent ruling.

 

Update: Lt. Governor Upholds Judge's Decision on Obama's Eligibility

In what attorney Mario Apuzzo is calling a "sham of justice," a state judge has ruled against objectors seeking to remove President Barack Obama's name from New Jersey's upcoming primary ballot.

According to Apuzzo, the attorney representing New Jersey residents Nick Purpura and Ted Moran, Deputy Director and Administrative Law Judge Jeff Masin ruled against the ballot challenge following a more than three-hour hearing earlier this week. His decision, delivered to Apuzzo via email, was not based on the issues presented in the challenge, namely that Obama is not a natural born citizen of the United States and that a birth certificate released by the White House last April is fraudulent, but rather on a technicality, Apuzzo said.

The judge ruled that Obama's place on the ballot could not be removed by challenge because Obama, as president, automatically appears on the ballot and without his consent. Thus, Obama cannot be held immediately responsible for proving his eligibility. Apuzzo filed an exception and the matter was passed along to New Jersey Secretary of State Kim Guadagno who will have to make the final determination at this stage.

Should Guadagno uphold the court's decision, Apuzzo said he would file an appeal.

"The sham continues. In one way or another it's a sham of justice. Our judiciary is really taking us for a ride," Apuzzo said during a telephone interview Thursday. "How can they expect us to do something that the law doesn't allow for (challenging Obama's place on the ballot)? The logic is unbelievable."

Purpura, of Wall Township, and Moran, a Toms River resident, filed a challenge alleging that Obama has both failed to show proof that he was born in the U.S. and is not a natural born citizen because both of his parents are not U.S. citizens. According to the Constitution, Apuzzo charges, Obama is ineligible to serve as the country's president and should not appear on the state's June 5 primary ballot.

Obama was represented by Alexandra Hill of the Newark-based law firm Genova, Burn and Giantomasi.

What struck Apuzzo, he said, was not just the judge's decision, but a concession made by Hill that the court has no documented evidence of Obama's birth. Armed with a number of witnesses, including an expert who was willing to testify that Obama's birth certificate, posted online in April 2011 by the White House, was fraudulent, Apuzzo was instead told to holster his guns.

"We were willing to present that what's online has been manipulated by computer, human, or both and that it's not reliable. I told them I was ready to prove that and if they didn't want this witness to testify then concede that," he said. "I got Obama (Obama's attorney Hill) to concede that there is no evidence before the court as to his place of birth, which includes what's on the internet."

Though the judge ruled the Obama isn't required to prove his ballot eligibility, Apuzzo considers the concession a win of sorts, one he hopes will help his case gain traction should it appear before an appellate court. He stressed that he's willing to go as far as he can to prove that Obama does not belong on the state's ballot. Should that mean taking the case to the State Supreme Court or the U.S. Supreme Court, Apuzzo said he's ready.

JAY HG, what you say is true, the birthers have lost every case that has been brought, but, as in this case, not on the merits of their arguments, but on tehnicalities. Obama, very simply is not eligible, period. According to the controlling Supreme Court case, Minor v. Happersett, one must have 2 citizen parents. Obamas father was not a citizen, and at that point, the argument should be over. His birth certificate is moot. Means nothing, nada, zilch! It's just a smokescren. Repeating, 2 CITIZEN PARENTS, NOT ONE! And, for that very same reason, the republican new "rave" boy, Marco Rubio is not eligible, because he was born in 1971, and his parents did not even APLY for citizenship until 1975, HE ALSO, IS NOT ELIGIBLE!

Minor v. Happersett, 88 U.S. 162 (1875)?? d rash, what the heck are you talking about?

Try United States V. Wong Kim Ark 169 U.S. 649 (1898) which held that virtually everyone born in the US is a US citizen. [ "Jus soli" - Latin. right of the soil]

Minor v. Happersett was a case regarding women's suffrage (ruled that women were not allowed to vote), which was overruled by the Nineteenth Amendment in 1920 and updated by interpretations of the Fourteenth Amendment's Equal Protection Clause.

"The Constitution does not, in words, say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common-law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens, as distinguished from aliens or foreigners. Some authorities go further and include as citizens children born within the jurisdiction without reference to the citizenship of their [88 U.S. 162, 168] parents. The wording is not exclusionary, just inclusionary. There is no doubt that if both parents are citizens, then the child is a citizen. NOT that most parents must be citizens for the child to be a citizen.

Still if you want to quote a case that was used to deny women the right to vote, well, be my guest.

The Congressional Research Service has stated that the weight of scholarly legal and historical opinion indicates that the term means one who is entitled under the Constitution or laws of the United States to U.S. citizenship "at birth" or "by birth," including any child born "in" the United States, even to alien parents (other than to foreign diplomats serving their country), the children of United States citizens born abroad, and those born abroad of one citizen parent who has met U.S. residency requirements.

Hawaii is a state. I checked it out, it really is true. In the country, one parent of US origin. His mother is a US citizen.
OK, you can continue the birther claims. I certainly didn't want to confuse your beliefs with FACTS.

If there were no question as to Obama's eligibility he wouldn't have held his birth certificate, passport, school records, Selective Service certificate, etc. under lock and key for so long, spending over a million dollars to do so. Why the secrecy? We have a right to know all these things about our presidents. He now comes out with a phony BC and Selective Service record because he believes that now that he's been in office for 3 1/2 years it's too late to do anything about it. He may be right. He can't produce it because it simply does NOT exist. He has no American birth certificate because he was NOT born in America. Plain and simple. The courts are letting him slide for some HIDDEN, SECRET, and ULTERIOR reason, something they are hiding from the all of us.

This is such a sham & travesty of justice, especially when ALL other Presidential candidates have had to produce a valid, legitimate, and legal birth certificate, all except for this parasite.

If I ran for President I would absolutely produce my birth certificate in a heartbeat without reservation, hesitation, or procrastination because I was born here & damn proud of it!! I'm a true blue American born patriot!! It's so obvious Obama is a FRAUD through and through!

@Leigh. Sorry, but the President deserves respect, whether or not we voted for him or agree with him. The Constitution gives us the right to use free speech to voice our opposition. However, the likes of Kim Russell cross over into hate speech and their language is treasonous; they encourage overthrow of our democratic government. That's treason. Also, I've been to Afghanistan and I know first hand how lucky we are in America. It saddens me how so many people here think they have it so bad. Sure, we have some problems (most of the ones we're currently facing were inherited by the current President from his predecessor, or are caused by forces beyond his control - like the price of gasoline), but at least most of us get to eat every day and have roofs over our head; let alone the luxury of having a computer and the Internet! In addition, there are a number of administrative rulings that contradict what you are claiming. Try to deal with reality, as hard as that might be for you.

It's funny how someones concept of the law can be so skewed! lol!!! Just because Obama's Attorney said that the evidence was not before the court does NOT mean there was no evidence! It just means that the birth certificate was not presented as evidence... It's a procedural issue not a lack of evidence. The Judge said, hey, you don't have to produce the BC because the policy is that the President automatically appears on the ballot! Psychos!

I can not for the life of me understand these people. To become President or to hold other public office, the F.B.I. investigates the person. I myself once worked in the Office of the Mayor. In order to get that job, I was investigated, fingerprinted, had to take an oath on the Bible that I would be loyal to the Mayor, The City of New York, the State of New York, and to the United States of America. How do these Birthers think the President of the USA is not investigated to hold the highest office of the land???

As a retired attorney, I know that in Michigan we have a rule against attorneys bringing baseless claims. Perhaps Mr. Apuzzo ought to check his OWN credentials -- his bar license -- to see whether it has been revoked.
Of course, if an authenticated copy of the President's birth certificate HAD been presented to the court, Apuzzo would have argued that the "best evidence rule" required the ACTUAL document from Hawaii -- which naturally could not be obtained as it remains in the care and control of the State of Hawaii.
I wonder if Apuzzo's "clients" have actually paid him -- or if this is just his marketing scheme that will give attorneys an even worse name with the general public. Ah -- so many attorneys -- so few ambulances to chase.

I hope you are not comparing Nobama to Jesus. If so, it would be pointless to argue with you because you are beyond hope. And while Jesus fed the multitudes on several occasions and healed the sick, it also says in the Bible in 2 Thessalonians “The one who is unwilling to work shall not eat.” I do not discount that we should pay taxes, but we should ALL pay taxes. Currently less than half of people pay income tax and an increasingly large number are receiving refunds for more than they pay in, that is redistribution of wealth and rewards laziness. But lets look further at the Bible since you brought it up; in the Bible, land owners were instructed not to rape the fields and to leave some of the fruits so that the poor could come and collect some for their needs. They were not instructed to pick it and deliver it to those who wouldn't work to get it.

Correct...mostly. I wouldn't even call him progressive. He seems to me to be a slightly liberal moderate centrist. In fact, I consider him to be the best Republican candidate we could possibly field for the presidency.

Now, he does seem to want to return us to a time before the intellectual corruption of the Republican Party by the 'trickle-down' absurdity...to a time when the average person in the top 1% took 25 times the yearly income of the average person in the bottom 50%, instead of taking 100 times the income of the average person in the bottom 50% as is the case today. On the other hand, we had a society which worked then and which is increasingly untenable today, precisely because of the massive (an accelerating) increase in income inequality, so it's not difficult to appreciate his points on the subject.

For example, unless one believes that we must be a society in which survival of the fittest is the only imperative, a society in which a moment - or day, week, month, year, decade - of economic weakness on the part of an individual must produce his/her death from exposure or starvation, we should, as moral people, support the survival of those who are in need of help. There is no actual or valid reason to have government at all without such an ethic.

Without going too deeply into the history of this nation you could, if you had the mental capacity, quickly discover that two of the last three Republican presidents increased the national debt by an amount greater than any president before them: Reagan and Dubya. In fact, Dubya doubled it, which Obama is not on track to do, even by the end of his second term in office. Reagan left the country with 2.5 times the debt it had when he came into office.

Under Communism the State owns the means of production, right? News: Obama isn't even left of center. As to the legitimacy of his Hawaiin birth certificate - that argument falls into the realm of saying anything because it supports your prejudiced point of view. The state of Hawaii has repeatedly validated his certificate but that isn't enough for you is it? You can hurl insults all you want but facts are something you don't have. Not even evidence.. I think the 'bastard' remark was a slang term indicating the commenters disdain for Nobama rather than a literal remark questioning his legitimacy. The 2000 registered communists (and I'm taking your info at face value) would be registered...not necessarily all that are in the country. And regarding taxation, the US currently took the lead in highest corporate taxes...(yay us). And redistribution of wealth (aka, taxing the evil rich and giving it to the poor unfortunates who won't work) falls under the communist ideology, and Nobama is all for that. And as for the popular vote vs electoral vote with Bush: we have a democratic-republic...that is how it works, so neither could be truly considered a usurper. But the kicker is claiming Nobama isn't even left of center. He is so far left of center he's about to fall off the freakin' line. When you discover that the word 'legitimate' means legal, you can then discover that Obama has the ONLY legitimate birth certificate that it's possible to have. The Bush Republican Patriot Act (which, admittedly, most Democrats in Congress also voted for) standardized birth certificates in the U.S. You cannot get a copy of your hospital or doctor birth certificate anymore. If you still have one, fine, but it's not legal proof of your birth. You MUST have one of the new state birth certificates for any and all legal purposes now. What your mother received from the hospital when you were born is no longer valid. It's not illegal to have one, it just serves no legal purpose.

His comments to the Russians about what he will be able to do after his reelections is treason. He's going to be more flexible in allowing the Russians to control our missile defense system. This is a ridiculous argument. I am an American citizen, born in Illinois. My father was an American citizen, but my mother was a British citizen when I was born in 1948. She became an American citizen a year AFTER my birth, in 1949. I had dual citizenship - British AND American - until I was 18. Just because Obama's father was a Kenyan does not erase the fact that his MOTHER was an American citizen, and he was born in an American state - Hawaii. That is the law. He meets the criteria to be President. Only one parent has to be an American citizen, and if neither parent is an American citizen, if the child is born on U.S. soil, or one of its protectorates, that child is automatically an American citizen. The only reason these lunatics keep resurrecting this insane argument is because Obama is A) African American, B) a Democrat, C) a threat to the Republican agenda, and D) a damned good president.

I had no idea we were living in AZ with nutjobs like Sheriff A and 'ol Jan Brewer running around NJ. After last week's Morris County TP meeting, I was hoping this would be over. I hoped our citizens were better than that. But I should have known better. I suppose any state that could elect Christie as governor (tunnel project discrepancies, no civil rights for gays, etc.) would have its share of birthers. You all simply have TOO much time on your hands. President Obama has proven that he is a US citizen time and again. If you can't accept that, please try leaving the country for about 4 years, because he WILL be re-elected. Deal with it. And for those of you who are calling the president "satan": I wish that I could tell you what I really feel about that statement. I bet none of you called Bush,Jr. an idiot and we had daily reminders of that for 8 years. Shame on you. Just be happy that you can live in a country that allows you to spout such foolishness. You and everyone else knows that the tradition in this country is to call a child "black" if at least one of his or her parents is black. Unbelievable!!! Where to start.
First, a president is vetted by his party. The DNC was to have vetted Obama before putting him on the ballot. Second, just because someone dislikes Obama, that does not mean he/she is racist. It may possibly mean that he/she does not like his policies. I am one of those. If he stood for true fiscal conservative and constitutional values, he would get my vote.
Thirdly, has anyone questioned why it took him so long to even produce a birth certificate? He still has not released his school transcripts. How simple could that be. So instead of blindly accepting things for face value, how about asking questions and demanding answers instead of following like little lost sheep!!

John... it took so long to present the cert because:
1) It should never have been requested to begin with, and Mr. Obama was fighting the unfairness of the request.
2) Hawaii did not keep original paper certificates, they kept micro fische copies. So there WAS no original to present... which BTW explains why the presentations have been electronic -- not paper -- until recently
3) A hard copy of the micro fische had to be printed, authenticated and certified before it could be presented for public viewing.

Not all states keep records in the same manner, and for a state with limited 'storage space' ie a series of small municipalities across several islands, micro fische and electronic records make far more sense.

Romney has proven himself with the projects and successes he has had in business and management. Obama has not...look into his background. He is an excellent speaker, but his thinking is so far left. If Obama was not born in Hawaii, then the cover up would have required the most massive and successful conspiracy in history: every single employee, past and present, of the Hawaii Department of Vital Records, plus their friends and family members would have had to keep the secret and not been a whistle-blower. Do you know what the Tea Party represents? Smaller government and lower taxes. How can that be bad? Everyone should want that. Our governemnt grows bigger and bigger with every election. Superjew...not at all! And, I agree with you...firstly, I am a registered Democrat who has finally taken off my liberal hat, and studied the other side. I do believe that there are both big govt. Dems and Repub. But...I don't think either of them are correct. Big govt. means wasteful spending of our hard earned tax money. I, for one...have learned that I make better choices of what to do with my money, than the govt. ever can. I want lower taxes so that the govt. doesn't take my money and squander it. They do it all the time! Most govt. agencies MUST spend all of their money, whether they need to or not, in order to get a budget increase for the following year. That's crazy!! The more money we give our Congress, the more they waste it! Do you not see that!?! And...today's Rebup's are not fascists. Fascists want an elite supreme ruler with a single party. Not at all what a conservative wants. They want all people to work hard, be responsible for their own successes, less govt to take away our freedoms.

And Obama is a natural born U.S. citizen because he was born in Hawaii, which became a state before he was born and therefore is and was U.S. soil. Even children of undocumented workers are considered to be U.S. citizens if they were born on U.S. soil -- even in the middle of the desert with no doctor around.

My original birth certificate, filed in the County Records office of the County of Los Angeles in 1941 is not available to me or to anyone else. It may or may not even exist. What is available to everyone is a microfiche record which, because it is so old, is printed out with white lettering on a gray/charcoal background. The hard-copy is stamped or embossed by the County to prove its authenticity. Nobody can present "original" hard copies on the internet and they certainly can't allow them to be circulated.

The same is true of death certificates. There is only one original that is signed by the attending physician. That resides in the state or county records. People can obtain certified copies of death certificates. But they are copies, with official stamps of them -- not the original. That is the best anyone can do and those certified copies are accepted in the courts. Heck, the courts will even accept photocopies of the copy which includes a copy of the official stamp. It's obvious birthers willfully are distorting the availability of "originals". That's what happens when your attorney bought his/her license to practice from an online school.

There are 2 types of birthers out there.

First are the complete idiots that even if God came down from the heavens and said Obama was born int he USA would then accuse God of being a fake. These people live in their own world where facts are what they make up.

The second type of birthers are those that use the idiots mentioned above for their own political purposes. You know what I mean, those that say, "if Obama says he was born in the USA then I take him at his word." Subtle hints that he might not be a US born citizen. It would be like if I said, "if Mitch McConnell and Erik Cantor say they are not card carrying communists then I take them at their word. Oh? They never said they were not card carrying communists? Oh dear." Now I am not suggesting that McConnell and Cantor are communists but can you think of a better way to undermine the US than by having people masquerade and conservatives while obstructing progress? It does sound suspicious since it was Cantor leading the tea party in the House to grand stand thus costing the US to loses its A rating last year.

The disparaged socialist countries, such as those in Scandanavia, New Zealand and elsewhere, are doing quite well, thank you, with health care afforded to their entire population and their old-age security systems funded far into the future. and they have a better standard of living and a stronger middle class. And the "American Dream" can mean different things to different people. To some, it is the defense of a 15% tax rate on their millions gained from "unearned income" (Wall street speculation and financial chicanery) against the demands of tax rate fairness from those who work by the sweat of their brow and pay a 25-35% tax rate. and what is most ironic of all is that so many lunch-bucket and brown bag Republicans march in lockstep to the tune called by their wealthy betters (some of whom are constructing an elevator in the garage of their $12 million fifth home) down the path to their own economic destruction.

There is NO COMPARISON to the situation we have. And, everyone I know is more than willing to give up any social program, if we can save the country. In most cases, that 15% tax rate is from investment money. Money that they earned previously and have already paid their 25-35% on, so they are in many cases...paying almost double. And...I WISH that I was able to build an elevator in my $12 million home. That would mean that I had worked hard...made my wealth...and had succeeded in attaining the Amercian Dream. Hey Diogenes...Mitt already paid his taxes on the original money he made...way back. Now, he's fortunate enough to use that money made and invest in our country...therefore, only paying capital gain taxes, which is 13-14%. Get your facts straight. Do you think he (and other successful business people) should have to pay the high rate, twice on the same money? He takes the money he made...and invests it in businesses, etc. That's why Congress has in the past, felt like capital gains taxes should not be as high...it's money that has already been taxed. Plus, he is doing what our laws say he should be doing...along with the Obamas. If you force our investor's to pay more taxes, perhaps job creation would decrease. That is the thinking...and reality.

The GOP owned Congress for 12 straight years, half of which they also had the White House. And guess what happened? Torture. Abu Ghirab. Exploding deficits. A wrecked economy. Illegal wiretapping BEFORE 9/11 (remember that?). America tried it the GOP way, and everything went to shit. And conservatives are having a real hard time facing that, especially when they were so convinced that Jesus Christ made GWB president. I feel sorry for them, but only so sorry. All of the moderates have fled the party; recent polls show a healthy amount of Republicans are going to vote for Obama this time around. Why not? He reminds them of Reagan. Jwagz, think of Obama, as your punishment for supporting Bush. You put in a guy who had no interest in governing effectively, he was an ideologue, and his ideology failed when faced with reality.

Iraq would become a becon of democracy and other Middle Eastern countries would fall like dominoes, remember that? While the middle east has overthrown some governments, none of it had to do with the Iraq war, that was a giant waste of tax dollars and lives.

George W Bush, when he passed his tax cuts said that the lower revenue from lower spending would serve as a "fiscal straight jacket" on congress. He then proceeded to not veto a single spending bill from the Republican congress, and earmarks exploded during his tenure as a result.

Bridge to no-where, that was put into a highway spending bill by a Republican Senator from Alaska.

You clearly are not grounded in reality, I would suspect you were trolling us if it wasn't for the fact that there really are some Americans who think that way. Its just such an odd way of looking at the world, with extreme arrogance and ignorance.

Currently, I see the Republican party learning absolutely NOTHING from the failures under George W Bush. They want to continue lowering taxes, which didn't really work at doing anything but exploding the debt, they want America in a perpetual state of war, they don't believe in science and try to pass creationism and make climate change into a political issue. Its a dying party pretty much.

I especially enjoyed this quip from a judicial opinion throwing out an appeal of his related to his protracted and acrimonious divorce proceedings: "...In large part, Plaintiff's arguments are unfounded, nonsensical and/ or incorrect ..."

I just think it odd that America needs to be defended from Obama winning the New Jersey primary. It's laughable really, given that the NJ primary is in June and typically not a factor in the selection of a candidate. And certainly not this election, with Obama the incumbent. Which brings us to the real reason for this court case: make a lot of noise and raise emotions. Notice the hundreds of comments back and forth here. None of the birthers commenting here have made any sort of logical argument. They just keep blathering on to keep the discussion going. I recommend leaving them to their silly games. Ok I've been reading all these comments and just have to clear up a few things. First of all there is a whole lot of fallacies in argumentation going on within these posts. Second of all the issue of whether or not Barrack is qualified under our constitution is a valid one. The reason is this, but from what I understand at the time Barrack was born U.S. Law required that in order for him to be "natural born" both parents had to be born in the U.S. Barracks father was not born in the U.S. but rather in Kenya and that is well known. Therefore under the law at the time Barrack Obama would not be eligible for the Presidency. The other things to consider are the fact all his records are sealed and the birth certificate released by the White House appears to have been forged. Now I'm sure some of you are going to reply and start ranting about Arpaio being a racist or whatever or say things to discredit the investigators who looked into the matter, but just keep in mind that all one has to do is look at the evidence, if the investigators are wrong then attack the evidence and not the people. Show how they are wrong. The other issue is Obama has also spent upwards of 1.7million dollars to keep his records from being released. Why? What sense does that make? Oh and the reason that the GOP has not pushed this issue is because there is really no difference between the Dem and Rep. You should all know this by now. Come on guys divide and conquer. Oldest trick in the book.

Obfiscation. By resorting to hyperbole you reveal yourself as being the one wanting to present a fantastic argument. All we want is our day in court to present the evidence. If Arpaio's evidence is false then it must either be doctored to make the case or these people bringing it before the courts are insincere in their efforts. In the first instance if documents are being falsified to make a case then it is Arpaio and all his crew that will be subject to prosecution for tampering with evidence. I guess he's willing to take that chance. In the second instance, if these people are not genuine in the efforts to pursue this then it can easily be smacked down in court and then all you on the Left can gloat to your heart's content with this definitive action that will bring all this to a close.

The argument between socialist vs free market is one that will never be actually settled, mostly because neither a free market system or a socialist one has ever existed. Birthers don't understand English. In Minor v. Happersett, the court said the following:

“The Constitution does not in words say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives or natural-born citizens, as distinguished from aliens or foreigners. Some authorities go further and include as citizens children born within the jurisdiction without reference to the citizenship of their parents. As to this class there have been doubts, but never as to the first. For the purposes of this case, it is not necessary to solve these doubts…..”

First, the court did not solve these doubts. Second, the court's assertion that anyone born here of two citizens is clearly a natural born citizen does not mean that that is the only case for someone being a natural born citizen. A wind storm in Florida with winds of 150 mph is clearly a hurricane. This statement does not mean that a wind storm of 149 mph is not a hurricane.

Actually the folks that claim "birthers" cannot accept the "facts" are themselves the ones that are refusing to acknowledge the FACT that Obama is not eligible. First, Wong only speaks to citizens. It has NOTHING to do with "Natural Born Citizens" while Minor vs Happersett SPECIFALLY construed article two, section one, clause five, the requirement for anyone running for the office to be a natural born citizen. Minor IS precedent and has been cited in previous cases as such.

The lame assertion that birthers are racists falls into the "I don't have a logical argument so I'll call you a name" category. Rubio is NOT eligible and he is NOT black. Bill & Hillary Clinton have both stated that Barry is not eligible and Cigar Willy was America's first "black" president, LOL.

Democrats are racist because they believe that black America would riot were Barry held to the same standards of conduct and legal requirement as a white person or "white" Hispanic.

I have to ask myself why a President who states he is very concerned about the "everyday person" and wants to make things "fair" in this country has no problem taking numerous vacations on our tax dollars when so many are just trying to get by. Many regular people can't even afford to take a "driving vacation" these days.

I read the article you're referring to about the layering. The investigation that was conducted had already looked at the optimization issue and considered it. They took the document to several digital forensic experts and it was determined that the optimization done was not done randomly by a computer but rather with logic based on the number of layers that computer optimization creates verses something this is man-made or created with logic. They were also able to pick and move the registration and date stamp leaving a white background which told them that the green safety paper was applied last. If it was a legitimate document the green safety paper would have appeared evenly throughout the entire document without leaving any white spaces. In other words the green background doesn't fill in where other fonts are located so it's indictive of being applied last to the document. It should have been there from the beginning. As a photographer and a frequent user of photoshop I can definately understand what the investigators are saying and it makes sense to me. I would also like to point out the vetting process for candidates. THERE ARE NONE about three years ago I called the elections division of about 13 of our states and asked them point blank how they vet candidnates before they're on the ballot. I was told that they don't in every case. They fill out document under penalty of perjury they meet the requirements and that's it. No vetting whatsover.

@Patrick, He's not my President Obama, I didn't vote for him. Therefore there is no meeting of the minds and I'm not bound to anything he does. Nor do I have a Representative. That guy who lives in what they call a district doesn't represent me. I am not a signatory to the constitution so how is their system bound to me? What binds me to their laws. It's like General Motors creating rules for the company and trying to apply them to people who work for Toyota. The United States is a Federal Corporation 28 UCS 3002. I don't have anything to do with that corporation. Hell there is even a law in California that says "The United States is in the District of Columbia" It can be found in California Commercial Code section 9307(H). You know how many traffic tickets I've gotten out of because that. "Officer would I have had to be in the State of California at the time of the alledged offence" "Yes" "Is the State of California in the United States?" "Of course". Then I quote 9307(H) and show how he is 3000 miles outside his jurisdiction. Case dismissed. All fun aside. Just maybe our country was hijacked a long time ago then incorporated and now the constitution doesn't really apply anymore excpet for lip service purposes. Just maybe Barrack Obama is qualified to be President of the United States. Because the United States under Federal law is a Corporation and NOT the Dejur Government which we all thought it was and Obama has been selected/elected to serve as CEO.

Ed- I have really been trying not to come back to this. I have children, I made some life decisions when I was younger that I do not regret. I guess my beef is with those who stand outside places yelling profanity to those in the building. Or the old man in my town, who instead of helping the homeless down the street, has never missed a day picketing. Or of my town with all the religious people who when they leave church, whatever the pastor, or priest or whomever is forgotten and they call their neighbors yelling at them and yes calling on Jesus to strike them down, because a tree is casting shadow on their rose bushes.

Monster, I don't know many women who if you asked them if they would like to be murdered would say yes. Baby women have rights too. They have the right to life and that it is their constitutional right that is being taken from them. In addition Obama initiated and passed a bill as a junior senator that takes medical care away from a late term aborted fetus. Can you imagine the pain and torture of laying in a trash can dying after you have been aborted?
If this was happening to the whales, dogs or ants in this country every animal rights group would be protesting and demanding change.
So why when a baby is tortured and killed it's called a women's right? Doesn't the baby women have a right?

So you don't see the difference between a woman asking to be murdered, and a life form that has of yet no conscious thought?
Also you state that "these babes are lying in the trash can dying after having been aborted". You called the fetuses baby women. You say if it were an animals everybody would be out there people would be up in arms. Well apparently Baby women have you. My post are for my enjoyment. Too realize that those of you say you have plenty of black friends and your not a racist? Face it we ALL have prejudices, we all have a hard time trusting a black man to hang out with you and something goes missing, your telling me that no one would at the black man and suggest maybe he might have it. Thats okay were all friends. Next time that you go into a bar that is predominately white. Look for the minorites. There some wait staff that are working in the kitchen, bus boys. Ask him where is the closest exit to from where you stand next to him, bet you he knows where it is. As a person who has dealt with a cornucopia of reactions to how I look, why is my hair so soft, you don't talk like the other black people.

I just reread your opening statement, and started chuckling all over again. No, I am not heartless. I just believe in a woman's right to choose. If giving up a child is the only option, why are there so many babies from foreign countries. Do we need to take on other peoples children as well as debt. Have you actually ever crunched the numbers of homeless children, Hotel/motel children? How often to do you go down to any homeless shelter and volunteer? Have you ever looked into the eyes of a homeless person and asked their story? Are you so high and mighty that you too can't see "The Truth". Why are you so worried about everyone else business? Is there nothing else to occupy your time.
He's President!
He's made some really good choices and yes some bad.
Gee, has any other President made errors, or thought he was doing good for the people, but it came back and bit him in the ass.
Whom do you think would make a good President?

@Jim-First of all I'm not a Republican. Second that's correct if I don't vote the President than there is no meeting of the minds and he is not my President. Elections are nothing more than agreements and agreements are governed by contract law. How is it I'm bound to the decisions of another if I'm not in agreement with those decisions. There is no meeting of the minds and therefore no contractual obligation to each other. If everyone simply understood this we would clean up the mess in Washington tomorrow. Furthermore the constitution itself is a contract between those who signed and those who take seats of government that the constitution itself creates. I never signed the constitution and therefore I have no obligation to it either. If you want to be bound to the considerations of others you have every right to do that. As for me I choose to be free and govern myself. And another thing, I studied the Cal. Vehicle Code and did a legislative historical analysis on the vehicle laws in this state for over 10 years. What I discovered was, the drivers license and registration provisions don't apply to me. So... I don't participate in their system, but that wasn't enough to win the argument in court. I learned I had to know courtroom procedure and now that I have that down. I win every case very easily based upon the fact that infractions aren't crimes and therefore not arrestable. In other words no crime alleged which = No Subject Matter Jurisdiction.

You're right Monster those innocent babies that were sent off to war is bullshit. You seem to think that just because I think Obama is a fraud that you think I support the war and like Bush. Can't be further from the truth. Like I said in my other posts. I'm waaayyyy beyond the left right paradigm in fact I'm so over that shit it would take most a lifetime to catch up with me. BTW all life whether it be a cell or a human being has consciousness to one degree or another. Keep this in mind. There are only two laws in this world. Do no harm. And Honor your agreements. We can get along pretty well in this world if we simply lived by those two laws. Everything else is pretty BS.

All of the sudden I get a bunch of posts popping up in my e-mail. I'm baack...... again that is my choice, where is the evidence that all life have a consciousness? I'm being asked for evidence, yet are you willing to show me yours? I'm not debating Matthew,you smart ass I am stating a belief I believe to be true. Just like you believe in whatever it is you believe.
To the supreme IDIOT who thinks I am blasé about killing children....please go to some third world country where children are starving and malnourished, how many of them do you think are adopted? Or have you adopted 1already?
Using abortion as a form of birth control is wrong on any level, just as some passer by getting to decide what I do with my body. Susan what scares the "jeepers" out of me, is that you really are calling them "baby women", really? Does that even sound odd to anyone else? Or the statement of "the pain and torture the baby women feel after they have been aborted, laying in a trash can?" yes, I know the quote is not word for word. Beyond that, huh.......? I realize you believe you are speaking up in support of all women (and of course baby women), in fact are hurting the case. Your logic is questionable, the nickname is ridiculous and you seem to like comparing apples to oranges.
I really don't need or want a reply, I'm sure they will come anyway, but please stay away from my children with your beliefs, ie: nonsense. I want them to believe in Santa as long as possible.

In 1969, Saul Alinsky received the Pacem in Terris Peace and Freedom Award, given annually by a coalition of Catholic groups in the Midwest to commemorate an encyclical about human rights and alternatives to war written by Pope John XXIII. Most honorees have been ardent reformers of one faith or another: Martin Luther King, Jr., Desmond Tutu, Cesar Chavez, Daniel Berrigan, and Jim Wallis are on the list—as is Lech Walesa. Mother Teresa also received this award 7 years after Alinsky. Alinsky often worked with religious groups to help the poor and disenfranchised.

If any doubt exists as to the eligibility of the holder of the highest office in America, the Constitution is our authority. All Americans are imperiled if indeed the President is Constitutionally ineligible. Among the many perils, a significant peril is that any of the multitude of actions executed by the office would be potentially invalid. It's scary to me to hear commenters dismissing these concerns as if the operation of our Constitution could be merely dismissed by popular opinion or by impugning the motives of the protesters. I also find it amazing that a judge would conclude that since the law only requires a certification of eligibility but does not specify any documentation requirement, eligibility cannot be challenged based on documentation, fraudulent or not. How does this serve the public interest? Hugo Chavez could run in the New Jersey Presidential Primary under that reasoning. In other words, New Jersey law states the requirements for office, but the Secretary of State has no effectual means to ensure these requirements are met. It's Twilight Zone. Sooner or later a court of competent jurisdiction will decide the core issue and until that time it is irrelevant what public opinion says, only what the Constitution says.

Let's just summarize, shall we:
1. Obama is not a citizen
2. Therefore anybody who voted for him is either a criminal accomplice or non compos mentis
3. Obama is a dictator who answers to Congress and the Judiciary and to the people who either want or don't want him elected
4. Obama is destroying America: he wants more pregnant illegal immigrants here so their children can vote for him [ okay, maybe we're stretching on that a bit ]

5. Before Obama became President, this country was one small step below the Garden of Eden, where only those who really, truly and deeply deserved where allowed to feed at the public trough.

AND BY THE WAY, has anybody seen Obama's navel? It's not bad enough he's spent hundreds of millions of dollars that could have been spent preventing birth control; we're not even sure he's human. Let's see a navel. Let's see PROOF of his being born on earth. Don't you think it's just a wee bit scary that he's never addressed this issue. Why the silence? What does he have to hide, other than the fact that this country's being run by beings from the Andromeda Galaxy. Monster - First of all, where do you get the idea that i threatened a law enforcement officer? Second, I don't need to hide behind a wall with a shotgun married to 10 women shouting bible scripture. (how about dropping the stereotyping). I'm out in the open and if I find a law tolerable and I'll tolerate it, if I don't find it tolerable then I won't tolerate it and I'll do my best to defend myself for those decisions. As man such as yourself with a brain and the ability to critically analyze I would hope that you have sense to do the same instead of having blind loyalty to the point of complete surrender of your own integrity. You are an elitists wet dream. You're a slave who thinks he is free. You are a psychopolitical operative, an unknowing and unwitting participant in deception by being deceived yourself. An anaconda is slowly squeezing the life out of you while this same anaconda is making sure you're plenty entertained with sports and Lady Gaga and when you're not being entertained, you're simply trying to survive. I feel sorry for you because you have been to dumped down, numb, and apathetic to realize that something is squeezing the life out of you, let alone knowing who or what it is. I know it hurts to have to admit that and you will hate me for telling you the truth, but that's ok because it's for your own good. Bless your heart...you have issues. Why do YOU think anything you say is going to impact my decision making? I decide for myself and my children. You want to talk about anacondas squeezing the life out of me? The anaconda doesn't have to because my kids are doing it all by themselves. Soccer practice, dance recitals, piano recitals, Girls on the Run, play dates, homework, PTO bullsmacky, volunteering at shelters, putting meals on the table, putting grouchy kids to sleep. I LOVE my life. With all of the chaos and drama and goodnight kisses, I couldn't ask for a better life, (well unless I could do the Jedi mind trick on you.). Two laws of the land? Funny I thought there were a couple wrong, I can admit that I'm not as up to date on the birther issues. I just find it a bit hardcore to suggest its all a shame. If you read theses posts you'll see the several different interpretations of the constitution; but I'm supposed to believe what you say over anyone else.
I'm very sorry, because you annoy me on every level. I know I'm not liked by most people on this site, that's okay. I tell my children daily they weren't put on this earth to be liked by everyone, nor do they need to like anyone in return. I know I'm being harsh, but your reasoning and what you believe is logical is just off, by any standard.

Monster - You ask "Why do YOU think anything you say is going to impact my decision making? It's because I assume you have the ability to critically think. Are you saying that there is nothing I can possibly say even if YOU see it as having some validity that will change your decision making? That doesn't sound healthy to me. I'm willing to change my view if someone would simply point out the actual flaw in my arguments verses attacking my character. My goal is not to invalidate you or anyone else here in anyway but just provide data so people can make up their own minds. I have looked at the many other posts on here with regards to the their interpretation of the natural born citizenship provision. Unfortunately you can tell most of the them don't know how to make distinction between natural born citizenship and U.S. Citizenship. One is a civic status while the other is a political status. Then you have those quoting the Wong Ark case which has to do with the 14th amendment citizeship and absolutely nothing to do with natural born under article 2 section 1 clause 5. My view of the natural born citizenship is not my opinion I'm relying on the Supreme Courts interpretation, historical analysis, John Jay's letter he wrote to George Washington on the issue, as well as the original intent of the framers. Is there something else I should be relying on? If so, please tell me.

Monster it's not what I say nor "my" beliefs. I continue to suggest you educate yourself on the FACTS. If not for yourself then do it for your children. As their future is at risk of losing many of the freedoms that many men and women fought and died for in this great country.

The birther issue is only one of many questionable and ethical issues that have been raised, researched and revealed about this administration.

I think I annoy you because you don't want to hear the truth it is easier to live for most to live in a bubble of denial.
