Middletown Man Indicted on Charges He Sold Oxycodone to Undercover Cop

Grand jury affirms 14 charges related to the alleged sale of the illegal drug to an undercover officer with the Monmouth County Prosecutor's Office, twice in 2012.

A Middletown resident will stand trial on more than a dozen charges related to illegally selling oxycodone to an undercover Monmouth County Prosecutor's Officer while near public school grounds, and another time near the Henry Hudson Trail in Keansburg.

Frederick DiCapua, 50, of Thompson Avenue was indicted along with Dawn Cirone, 43, of Willowvale Drive of Toledo, OH.

According to court documents, DiCapua and Cirone worked as a team to acquire and sell the highly addictive illegal drug.

On Feb. 1, 2012, they allegedly sold the drug to an undercover police officer posing as a buyer within 1,000 feet of the Joseph C. Caruso Elementary School and 500 feet of the Monmouth County Park System's multiuse Henry Hudson Trail. 

On Feb. 3, 2012 police say they again sold the drug to the same officer within 1,000 feet of the Ocean Avenue Elementary School.

Cirone was indicted on additional charges stemming from an alleged Feb. 28 sale to an undercover officer. 

The majority of the 14 offenses DiCapua faces are considered third-degree charges, which carry the potential for 3-5 years in prison if a defendant is found guilty.

Intention to distribute illegal drugs while within 500 feet of a public park, or distribution within 500 feet of a public park,  is a second degree crime and carries with it the potential of a 5-10 year prison sentence if a defendant is found guilty.

The grand jury's vote to indict is a formal charge and not a conviction. The defendants are presumed innocent until proven guilty in a court of law.
