Middletown Crash Victim's Family Wants Criminal Charges Filed

Monroe man died after a September West Front Street crash.

Family members of a Monroe man killed in a Middletown traffic crash last year want charges filed against the driver at fault, according to a report on NJ.com.

Robert DePalma was driving a motorcycle on West Front Street toward Red Bank when he was hit by a car traveling in the opposite direction that was turning left onto Harbor Green Circle, police said following the September 2013 incident

Now, one of DePalma's sons is questioning why authorities haven't filed criminal charges against the driver, Daniella Coccurello, 23, of Lincroft. The Monmouth County Prosecutor's Office is still investigating the case and cannot release details, the NJ.com report states

IF everyone of us who caused a vehicle accident that resulted in injuries or deaths was charged with a crime __ very few of us would not have a criminal record. It was 'an accident'. Shyt happens and the motor vehilce merely did not see the motorcyclist. The automobile driver had no intent of injuring or killing anyone. This is a prime example as to why motorcyclist should always drive with their headlight on at all times to make it easier for motorists to see them.

If the motorist "did not see the motorcyclist" then they committed a crime and should be charged.

Then there are some motorcyclists who travel to fast for the road conditions and traffic conditions. I'm not saying that is what happened in this case but i have seen motorcyclists going to fast, splitting lanes on routes 35 and 36 as well as other roads. May years ago my father was driving when we were younger and as he was making a left hand with his turn signal on way in advance and while making the turn turn a motorcycle ran into the back right hand of our car. Fortunately for him he only sustained minor injuries but he was not following at a close distance and was not paying attention. I'm not against motorcycles and the people that ride them but I am against the motorcyclists who don't drive at the posted speed limit and have unsafe habits.

Very nice, if you are not against motorcyclists why bother with that completely negative story that has nothing to do with the issue. A man was killed, someones father and they deserve a police investigation and if charges are warranted, applied. If the case is recorded as "death by misadventure" the family will not receive recompense for the death of a father who probably financially supported them.
