A Middletown man has been indicted for vehicular homicide in connection with a fatal accident that resulted in the death of a teenaged boy who was waiting for the school bus in the Port Monmouth section of the township last year.
Monmouth County Prosecutor Peter Warshaw signed off on the indictment dated June 30, 2011. While not an indication of guilt, the indictment signifies that a grand jury deemed there was enough evidence to move forward with prosecution of the second degree crime charge lodged against McDonald Coxson, now 56, of 128 Main St., Port Monmouth, who "on or about June 11, 2010, in or about the Township of Middletown … commit(ted) the crime of vehicular homicide, by driving a vehicle or vessel recklessly, thereby causing the death of R.V.," according to the indictiment.
According to 2010 police records, the accident happened on June 11, 2010 at 7:26 a.m. at the intersection of Main Street and Gordon Court in the Port Monmouth section of the township, where the victim, a 13-year-old boy, was waiting for his school bus.
Coxson was operating the vehicle, a mini van, which first struck fixed objects and then the boy, who subsequently died of the injuries he sustained from being hit by the van.
No charges were ever levied against Coxson for driving under the influence.
