M'town Man Indicted for 2010 Fatality

Monmouth County Prosecutor's Office indictment stems from incident of van veering off road, killing boy

A Middletown man has been indicted for vehicular homicide in connection with a fatal accident that resulted in the death of a teenaged boy who was waiting for the school bus in the Port Monmouth section of the township last year.

Monmouth County Prosecutor Peter Warshaw signed off on the indictment dated June 30, 2011. While not an indication of guilt, the indictment signifies that a grand jury deemed there was enough evidence to move forward with prosecution of the second degree crime charge lodged against McDonald Coxson, now 56, of 128 Main St., Port Monmouth, who "on or about June 11, 2010, in or about the Township of Middletown … commit(ted) the crime of vehicular homicide, by driving a vehicle or vessel recklessly, thereby causing the death of R.V.," according to the indictiment.

According to 2010 police records, the accident happened on June 11, 2010 at 7:26 a.m. at the intersection of Main Street and Gordon Court in the Port Monmouth section of the township, where the victim, a 13-year-old boy, was waiting for his school bus.

Coxson was operating the vehicle, a mini van, which first struck fixed objects and then the boy, who subsequently died of the injuries he sustained from being hit by the van.

No charges were ever levied against Coxson for driving under the influence.

So, was he driving under the influence if no charges were ever filed? I thought he worked the night shift and fell asleep at the wheel. Tragic for all involved.

This is a good example as to why our taxes in NJ are so high and the State is going broke. It was "AN ACCIDENT" there was no intent on the drives part to hurt or injure anyone. The driver is not a criminal who went out that day and said hey let's go kill or injure someone.The more people we needless place into prison the higher and higher the costs will go in NJ. What do we as a society gain when we place people in jail for having an accident?? Is anyone really that foolish to think such actions will help to prevent any accidents???

Oh, I am so glad to see that you are preserving history. My husband & I visited your town aRead More couple of weeks ago. My 9th Great Grandfather Thomas Whitlock is buried in the Old First Baptist Church yard. I was honored to stand on the porch of the home he helped build and lived in at Shoal Harbor. The name has changed to the Wilson-Seabrook House and now the Bayshore Activities Center. Wow! Too bad all the museum pieces were removed. I would love to have seen them.
